Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", or "your") and Motion World Connect (Pty) Ltd ("the Company", "we", "our", or "us"), a company incorporated under the laws of the Republic of South Africa.
By accessing our website, submitting an application, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
These Terms apply to all users of our platform, including business owners, entrepreneurs, investors, and any other parties who interact with Motion World Connect.
2. Our Services
Motion World Connect is a business facilitation and consultation company. Our core services include:
Business Consultation
Strategic advisory and feasibility analysis to assess your business readiness for investment and growth.
Capital Facilitation
Connecting South African businesses with suitable strategic partners, capital resources, and growth opportunities through our consulting process.
Strategic Partner Connections
As a secondary service, we facilitate curated introductions between our clients and our network of strategic partners when relevant to their goals.
Strategic Business Support
Ongoing guidance, resource access, and support throughout the funding and growth journey.
Subscription Platform
Access to our client portal, progress tracking, proposal management, and communication tools.
Important: Motion World Connect acts as a facilitator and consultant. We do not guarantee the availability of funding, the success of any investment, or specific financial outcomes. We facilitate connections and provide consultation — final decisions rest with the parties involved.
3. Eligibility Requirements
To use our services, your business must meet the following minimum requirements:
- Registered with the Companies and Intellectual Property Commission (CIPC) of South Africa
- Minimum 2 years of active trading history
- Annual revenue of R1M or more (or demonstrable growth trajectory)
- Up-to-date financial statements and tax compliance with SARS
- Bank statements for the last 6 months available for review
- Seeking R1M+ in funding, investment, or strategic capital
- Willingness to participate in our full consultation process
We reserve the right to decline any application that does not meet these requirements or that we determine, in our sole discretion, is not suitable for our services.
4. The Consultation Process
All businesses engaging our services are subject to our consultation process, which includes:
Initial Application Review
We review your submitted application and supporting documentation to assess basic eligibility.
Consultation Assessment
Our team conducts a thorough feasibility analysis, strategic review, and resource readiness evaluation of your business.
Strategic Partner Connection
Where relevant to your business goals, we curate introductions to our network of strategic partners as a secondary service to complement our consulting work.
Ongoing Support
We provide continued facilitation and consultation support throughout your funding and growth journey.
Completion of the consultation process does not guarantee placement with an investor or the securing of funding. Our role is to facilitate and consult, not to act as a financial services provider or investment advisor.
5. Subscriptions & Payments
5.1 Subscription Plans
Access to our client portal and services requires an active subscription. Plans are billed monthly in South African Rand (ZAR) and are subject to the pricing displayed on our Subscribe page at the time of purchase.
5.2 Payment Processing
Payments are processed securely through PayFast, a South African payment gateway. By subscribing, you authorise us to charge your selected payment method on a recurring monthly basis until you cancel.
5.3 Cancellation & Refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months or unused service periods, except where required by the Consumer Protection Act 68 of 2008 (CPA).
5.4 Price Changes
We reserve the right to modify subscription pricing with 30 days' written notice. Continued use of the service after the notice period constitutes acceptance of the new pricing.
6. Client Obligations
By using our services, you agree to:
- Provide accurate, complete, and up-to-date information at all times
- Notify us promptly of any material changes to your business or financial position
- Maintain all required regulatory compliance (CIPC, SARS, FICA) throughout the engagement
- Treat all investor introductions and third-party information as strictly confidential
- Not use our platform for any unlawful, fraudulent, or misleading purpose
- Not circumvent our facilitation process by engaging directly with investors introduced through our platform without our knowledge
- Cooperate fully with our consultation process and provide requested documentation timeously
7. Confidentiality
Both parties agree to maintain strict confidentiality regarding:
- All business information, financial data, and documentation shared during the engagement
- The identity and details of investors, capital partners, and other clients
- Our proprietary consultation methodologies, processes, and systems
- Any commercially sensitive information disclosed during the course of our relationship
This confidentiality obligation survives the termination of our engagement for a period of 3 (three) years.
8. Intellectual Property
All content on our platform — including text, graphics, logos, reports, and software — is the intellectual property of Motion World Connect (Pty) Ltd and is protected by South African copyright law.
You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent. You retain ownership of all business information and documentation you submit to us.
9. Limitation of Liability
To the maximum extent permitted by South African law:
- Motion World Connect is not liable for any failure to secure funding or investment for your business
- We are not responsible for the conduct, representations, or decisions of investors or capital partners introduced through our platform
- Our total liability to you shall not exceed the total subscription fees paid by you in the 12 months preceding the claim
- We are not liable for indirect, consequential, or special damages arising from the use of our services
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under the Consumer Protection Act 68 of 2008.
10. Termination
Either party may terminate the engagement:
- By you: Cancel your subscription at any time through your account settings or by contacting us.
- By us: We may suspend or terminate your access immediately if you breach these Terms, provide false information, or engage in conduct that is harmful to our business or other clients.
Upon termination, your access to the client portal will cease. Confidentiality obligations and any outstanding payment obligations survive termination.
11. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the South African courts.
We encourage you to contact us first to resolve any dispute amicably. If a resolution cannot be reached, either party may refer the matter to mediation before commencing legal proceedings.
12. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date and, where appropriate, by email. Continued use of our services after such changes constitutes your acceptance of the updated Terms.
